It is common practice for people with judgments against them that they are unable to pay to file bankruptcy and discharge their debts. Luckily the U.S. Bankruptcy code allows creditors (people who are owed money) to fight the dischargeability of judgments in cases where the Debtor (people who owe the money who are trying to discharge it away) has committed fraud, defalcation, larceny, embezzlement, or defalcation while acting in a fiduciary capacity. The Bankruptcy Code also allows creditors to fight bankruptcy where the debtor caused willful and malicious injury to the creditor, or where the debtor obtained the debt under false pretenses. All of these examples, are subject to Section 523 of the U.S. Bankruptcy Code, and also subject to local district rules.
