Oftentimes, the first time that a person realizes that they have a Civil Judgment against them is when their wages are garnished via an income execution or when their bank account has been frozen by debt collectors such as Rubin & Rothman LLC, Asset Acceptance LLC, ER Solutions , Inc., Foster & Garbus, Central Credit Management, LDG Financial Services LP, Associated Recovery Systems and NCO Financial Systems, Inc. among many others.

 

What many people do not realize is that a party cannot obtain a proper judgment against another party in New York State without first properly serving the party against which the judgment is sought with papers that initiate a lawsuit (i.e. a Summons and Complaint).

 

Proper service in New York State is not effectuated by a Plaintiff merely placing a Summons and Complaint in a mail box.   Merely mailing a Summons and Complaint to the person against whom a judgment is sought without taking other required legal steps is under the vast majority of circumstances (although a Judge can Order service of this type,  but this is rarely done) is improper service.

 

If you have been improperly served you can institute an action to Vacate the Judgment obtained against you.  Furthermore, if the time to serve you has expired, you have the right to ask that the case against you be dismissed for the failure to serve you within the 120 day period of time.  Finally, if your case is older than six years (in Contract cases, i.e.  Credit Card cases) you may ask the Court to dismiss the case completely because the Statute of Limitations has lapsed.  As soon as you delete this Judgment against you from your credit reports, you credit score should go up.
