What is a Divorce?
A divorce is the legal termination of a marriage by court order. The Supreme Court of New York handles divorce cases. You must have a Judge's signature on a divorce judgment to get your divorce. Although you can seek out child support, custody and maintenance in Family Court, you cannot get a divorce in Family Court.
An annulment is different from a divorce. In an annulment the Plaintiff is seeking finding that the marriage is not legally valid. In order to get an annulment you must prove bigamy, the incurable insanity of your spouse after five years or more, that the marriage was entered into as a result of fraud or duress or that at the time for marriage the Defendant is unable to have sexual intercourse with the spouse.
In Order to process a divorce or annulment, you must first purchase an index number and file a Summons and Verified Complaint or a Summons with Notice. Your spouse will then have to be notified about the divorce by service of the Summons with Notice (or Complaint) by an individual over 18 years of age and not a party to the action, on the Defendant. In an uncontested divorce the Defendant can waive the personal service requirement.
In order to start a divorce, you must meet the residency requirements (i.e. residence in New York state for a certain period of time) and plead certain grounds for divorce.
What is an Uncontested Divorce?
Your divorce will be uncontested if both you and your spouse want to get a divorce and agree about the terms of the divorce. This means you both must reach an agreement on issues such as custody, visitation, child support, maintenance and the disposition of the assets of the marriage.
Your divorce will be contested if your spouse does not want a divorce and disagrees about the grounds of the divorce and allocation of finances and what will happen with your children and/or property.
