ORDER OF PROTECTION
Are you the victim of domestic violence?
If you are a victim of domestic violence, I can file a petition in Court to have the individual perpetrating the violence removed from the home or arrested. This will require a Temporary Order of Protection. If the violence is against your children, I will help you obtain a court order allowing only supervised visitation with your child until the violence issues are dealt with properly.
Domestic violence sometimes will result in you being injured and perpetrated generally by a spouse or partner but it can also be a parent, child or other family member. Victims of domestic violence suffer physical injuries or suffer emotionally from the abuse.
The American Psychiatric Association states:
“Domestic violence is control by one partner over another in a dating, marital or live-in relationship. Domestic violence occurs in every culture, country and age group. It affects people from all socioeconomic, educational and religious backgrounds and takes place in same sex as well as heterosexual relationships. Women with fewer resources or greater perceived vulnerability—girls and those experiencing physical or psychiatric disabilities or living below the poverty line—are at even greater risk for domestic violence and lifetime abuse. Children are also affected by domestic violence, even if they do not witness it directly."
How Do You Know if You Are Being Abused?
The abuse will come in the form of your partner trying to isolate or control you. In the beginning it may be difficult to recognize because your partner may also seem very nice, caring and loving towards you. This might cause you to not go to the police or not file a Family Offense Petition in Family Court. After the abuse occurs, your partner may seem very apologetic and rationalize that the behavior was caused by you, that you provoked the situation or that some other situation, like your partner being stressed out or tired, caused the abuse.
You should ask yourself a number of questions to determine of you are a victim of domestic violence and perhaps should file for an Order of Protection either going to the Police or by Filing a Family Offense Petition. In New York State, a Family Offense Petition would be filed in the Family Court although you can also obtain an Order of Protection in Criminal Court. First question to ask yourself is have you ever been injured by your partner as a result of his or her violence. Has your partner forced you to engage in sexual activities? Does your partner try to control where you go, does your partner track your daily movements? Are you in constant fear of your partner's mood changes?
