Irretrievable Breakdown No Fault Divorce

Grounds for divorce are rules specifying when a person will be granted a divorce. Several grounds for fault divorce are adultery, cruelty, abandonment, mental illness, and incarceration. New York was one of the last states in the Country to adopt a no fault divorce.. In a no-fault divorce in New York State, a person must state the reason they want a divorce in their Summons with Notice and Verified Complaint. A no fault divorce occurs when the relationship is impossible to repair for a period of at least six months. No party is held to be responsible for the dissolution of the divorce. One of the parties must swear under oath that the relationship has broken down irretrievably for a period of at least six months; AND you and your spouse have either resolved all the economic issues of distribution of property, spousal support, child support, and counsel and/or experts fees and expenses, and the custody and visitation with the minor children of the marriage OR these issues have been decided by the court and incorporated into the final judgment of divorce.

Your divorce will be contested if your spouse does not want a divorce and disagrees about the grounds of the divorce and allocation of finances and what will happen with your children and/or property.
